CONDITIONS

A) Delivery Address

For now, the delivery address must be an address located in Canadian Territory.

Shipping of orders is ensured by Canada Post. You choose the address that suits you best: home, office, at friends. Once the order is shipped, you can follow it with Canada Post’s tracking system.

You should, however, take note that postal boxes are not acceptable for delivery.

B) Shipping Method and Fees

Take advantage of free delivery for a limited time on all orders of more than $300 before taxes.

All orders of less than $300 before taxes will be submitted to a fixed shipping fee. Orders will be shipped through Canada Post.

Standard Shipping

4 to 7 business days after the order.

Shipping confirmation and tracking number sent to your email.

Shipping fees: $14.

C) Delivery Date

When required, you will be submitted to the rules concerning the signature of an acknowledgment of receipt for the products. If you are absent from the place where you have asked the products to be delivered, it will be your responsibility to recuperate the products according to the delivery company’s rules, that is to say, Canada Post.

Delivery date is given only as an indicator and a delay does not constitute grounds for damages, refusal of merchandise or cancellation of the order. However, if the product has not been delivered within 30 days after the delivery date given in the order confirmation email, for any reason other than a “cas de force majeure”, the sale will be resolved once the product is returned to NOC. You will then be reimbursed the sum that will have been paid.

To return the product(s), you need to contact us at info@nocdesign.com. We will give you the information related to the reimbursement.

It is the only exception to the no reimbursement policy. Take note that delivery date is calculated in relation to the number of business days. This calculation excludes weekends and holidays. Also, during the end-of-year festivities, that is to say from November 15 to December 31, or for special events, delivery time can be longer. Delivery time can be up to 10 business days.

D) Exchange of Your Products

NOC designs and produces high quality creations. If the product you receive does not comply with the order because of an error or omission, or if you realize that your product has an apparent default, you have a 10-day delay from the date of receipt to return the product to us in its original state and in its packaging.

To return the product(s) to us, you need to contact us at info@nocdesign.com. We will give you the information concerning exchanging the product.

Shipping and handling fees are not refundable.

E) Returning Your Article

—Customized Product

Customized products cannot be reimbursed. If you are not totally satisfied with your product, we will modify it, as is reasonable, until you are satisfied, at no additional cost. To have your product modified, send us an email at info@nocdesign.com with the following information:

• Your name
• Invoice number
• Detailed description of your experience with your product
• Telephone number

A professional will contact you.

F) Price

NOC reserves the right to modify the prices of the products offered on the website at any time, without advance notice. All prices are in Canadian dollars. Once the transaction has been concluded on our website, the sale is final, without the possibility of being exchanged, except if the product does not comply because of an error or omission, or because it is defective (see the Exchange your product section above).

A) Safe Purchase

The protection of your information during your visit to nocdesign.com is very important for us. The safety and confidentiality of the information related to your credit card are protected by our partner: Internet Secure. When doing transactions on nocdesign.com, you will be transferred to the Internet Secure secure server where you will be invited to fill in a form to finish your transaction(s) with the information related to your credit card. This information is validated directly, in the most secure manner that exists on the market, thanks to the Secure Socket Layer (SSL) at 128-bit encryption technology. Only our partner’s secure server will access the information related to your credit card.

The on-line purchase ensures a higher level of safety and confidentiality than a purchase in a store, by telephone or through intermediaries that have access to your information.

B) Confidential Information

At NOC, we are devoted to offering you high quality products with an excellent service. In the view of achieving this end, we consider essential the confidentiality of the information you supply while you are on nocdesign.com. Access to the personal information is strictly reserved to the authorized personnel, for example: the invoicing agent or delivery agent.

C) Collection of Information

We obtain the information that is necessary to ship the merchandise. This includes your name, address, telephone number and electronic address. Also, we keep specific details about your purchases and your transactions with us. However, we encourage you to do it in order to allow us to make you live a personalized experience on our site.

D) Use and Disclosure of Information

We use the collected information to deliver merchandise, to send you promotional material by mail or email and to help us improve our online transaction service as well as our customer service.

A) Consent

Making an order implies full acceptance of the general sales conditions that are available on nocdesign.com and in particular at the moment that the sale is registered. They constitute the only agreement between the parties (NOC and the user) and prevail on any other document. The General Sales Conditions and the Safety and Confidentiality Policy as well as the Shipping and Return Policy constitute an indivisible whole.

B) Intellectual Property

All of the content (including the texts, photos, images, graphic elements, icons, sounds, trademarks) on the nocdesign.com website is the property of NOC and is protected by the laws on intellectual property applicable in Canada and by the principles of international law. Electronic copies and paper copies of the pages and photos of this website must only be used for personal use, the orders made on the website are only for individuals and companies who are “end users” rather than for resale. Use of the website, including its reproduction is prohibited without NOC’s written permission.

C) Trademark

The NOC trademark is a registered trademark and cannot be used without NOC’s consent and written permission.

D) Applicable Law and Jurisdiction

These conditions, the order and all of the actions that emanate from it are ruled by Canadian law. In the event of a dispute, but failing an amicable settlement, the parties recognize that only the courts of Quebec have jurisdiction.

E) Responsibility

Users who choose to use the nocdesign.com website do so on their own initiative and it is up to them to comply with all applicable local laws. The nocdesign.com user agrees to hold NOC, its directors, employees, agents and associates harmless from any damages that could be caused, of whatever nature, when using the nocdesign.com website.

F) Minors

NOC demands that all commercial transactions carried out on this website be made with adults (according to the laws of Québec) or with the consent of a parent or legal guardian who adheres to the stipulated conditions of use. Furthermore, the user accepts the responsibility for all uses of the website, including that made by minors who should be under their supervision.

G) Limited Availability and Price

NOC can limit the number of products ordered on the nocdesign.com website and refuse or cancel orders that have been confirmed and debited. Consequently, NOC will immediately apply a credit to your credit card for the same amount, if the credit card has been debited, for the amount of your order.

H) Links

The NOC website can have links to other websites that are not owned or controlled by NOC. We are not responsible for the confidentiality policies and content of these sites and it does not mean that NOC agrees with them in any manner whatsoever.

I) Review

NOC reserves the right to review its policies and general sales conditions. We can make changes to these policies and conditions at any time. These new policies and general sales conditions will be applicable once they are made available on the website. We encourage our users to consult this page in order to be informed of the changes that could be made. When important changes to the policies and general sales conditions are made, NOC will inform the owners of registered accounts of these changes by email.
